JUSTICE SATYAVRAT VERMA ORAL ORDER 20-05-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through the virtual Court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek bail in a case registered for the offences punishable under Sections 30(a), 36 and 41(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Allegation is of recovery of 2250.36 litres of liquor from a Pick-up Van.

Learned counsel for the petitioners submits that the petitioners are in custody since 15.03.2022, charge-sheet has been submitted and are persons with clean antecedent. Learned counsel further submits that petitioners were arrested from the

Patna High Court CR. MISC. No.24106 of 2022(2) dt.20-05-2022 2/2 spot and being driver and co-driver were not aware what the owner had kept in the pick-up van.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.

Considering the fact that the petitioners are in custody since 15.03.2022, charge-sheet has been submitted and are persons with clean antecedent, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Mohania P.S. Case No. 123 of 2022.
