Petitioner apprehends arrest in connection with Belhar P.S. Case No. 48 of 2023 registered for the offences under Sections 302 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a woman, she is innocent and has falsely been implicated in the instant case due to land dispute. Further submission is that the First Information Report has been lodged after a delay of three days without any explanation for the delay. It is also submitted that there is general and omnibus allegation against the petitioner and specific allegation is against coaccused persons.

No.26175 of 2023(2) dt.15-05-2023 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Banka in connection with Belhar P.S. Case No. 48 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
