2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.

3. As per the prosecution case, on 27.08.2022 at about 4 PM, the informant got telephonic information that the F.I.R. named accused persons including this petitioner were stealing iron from sugar mill Marhowrah and when the informant reached there, upon seeing the police party, the accused persons fled away leaving behind the loaded pick-up van.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner and he has been made accused in this case only on suspicion.

5. Learned A.P.P. for the State opposed the prayer for bail and submitted that petitioner has got two criminal antecedents of similar nature.

6. Considering the nature of accusation and criminal antecedents of similar nature, prayer for anticipatory bail of the petitioner is refused.
