JUSTICE RAJEEV RANJAN PRASAD ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 12-04-2018 Appellant herein Ram Sewak Singh has filed this appeal calling in question his conviction ordered by the 1st Additional Sessions Judge, Begusarai in Sessions Trial No.332 of 1993/2 of 1993 and convicting him to undergo life imprisonment for offence under Section 302/34 of the I.P.C.

Considering the fact that when the judgment was pronounced in the year 1995 Ram Sewak Singh was already more than 60 years of age, on 29.3.2018 we had requested the counsel

Patna High Court CR. APP (DB) No.71 of 1995 dt.12-04-2018 2/2 representing the State Government to seek instruction with regard to the whereabouts of Ram Sewak Singh and we are informed today on the basis of communication by the learned counsel for the State through the Superintendent of Police, Begusarai that Ram Sewak Singh, son of Late Jato Singh, the appellant herein has died more than 10 years back and certificates of the Ward Member have been produced in this regard.

Keeping in view the aforesaid, this appeal stands disposed of.
