The petitioner apprehends his arrest in Mansahi P.S. Case no. 54/2015, registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and different Sections of the Arms Act.

The informant apprehended Md. Islam, Suraj Sah and Subhash Gupta and alleged that he identified Md. Mubarak, Md. Raja, Md. Badal @ Badruddin, Md. Guddu and Md. Raju who managed to flee away from the place of occurrence. Md. Islam, the apprehended accused disclosed the name of two persons namely, Ravi Kumar Singh and Shailendra Singh but did not disclose the name of the petitioner before the investigating officer and when

Patna High Court Cr.Misc. No.40667 of 2015 (2) dt.05-10-2015 2/2 the police took the confessional statement of Md. Islam, he is said to have disclosed the name of the petitioner. Except the disclosure made by Md. Islam that too after much time, there is no further material against the petitioner.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Mansahi P.S. Case No. 54 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi/- U T
