JUSTICE PRABHAT KUMAR JHA ORAL ORDER 09-11-2016 Heard both sides. The petitioner apprehends his arrest in connection with Baheri P.S. Case No. 299/2009 registered under Sections 379 and 411 of the Indian Penal Code.
The informant alleged that his Splendor Pulse motor cycle bearing registration no. BR-1C-7258 was stolen by unknown accused. During course of investigation, one Jawahar Lal Deo was apprehended. He confessed his guilt and disclosed that the stolen motor cycle was kept in the Garage and different parts of the stolen motor cycle were recovered from the garage. The petitioner is the owner of the garage.
It is submitted that the chassis number and the
Patna High Court Cr.Misc. No.34243 of 2016 (4) dt.09-11-2016 engine number were not given in the F.I.R. but it has been specifically stated that the engine and the chassis of the stolen motor cycle were recovered from the garage of the petitioner and attachment order has already been issued against the petitioner. The petitioner is evading his appearance in the Court for the last seven years.
Having considered the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected.
