JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 09-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioners are apprehending their arrest in a case registered in connection with Pakaridayal P.S.Case No. 102 of 2020 for the offences punishable under Sections 341, 323, 379, 307/34 of the Indian Penal Code .

As per prosecution case, Balindra Kumar fall water in the field of informant, she protested, then all the F.I.R named accused person assaulted her with lathi, danda and iron rod caused injury on her head.

Learned counsel for the petitioner submits that there

Patna High Court CR. MISC. No.36251 of 2021(2) dt.09-03-2022 2/2 is case and counter case between the parties. No specific allegation of assault against the petitioners .From perusal of the injury report injury sustained by the informant, simple in nature. Petitioners have no criminal antecedent. On similar footing one co-accused has been granted bail in Cr. Misc. No. 31380 of 2021.

Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioners in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Motihari, East Champaran, in connection with Pakaridayal P.S Case No. 102 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
