JUSTICE ARUN KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioners and the learned APP appearing on behalf of the State. Petitioners apprehend their arrest in connection with Mohiuddin Nagar P.S. Case No.24 of 2017 registered under Sections 147, 148, 149, 341, 323, 325, 307, 302, 338 and 452 of the Indian Penal Code.
Allegation is that all accused persons forming an unlawful assembly entered into the house of the informant and they all assaulted his wife, son, cousin and other family members and thereafter the accused persons escaped away. Due to assault, the wife of the informant died.
Learned counsel for the petitioners submits that there
Patna High Court Cr.Misc. No.30262 of 2017 (2) dt.06-07-2017 2 / 2 is general and omnibus allegation against all accused persons, there is no specific allegation against them. Considering the aforesaid facts and circumstances of the case as also the nature of offence alleged, prayer for anticipatory bail on behalf of the petitioners is refused in connection with Mohiuddin Nagar P.S. Case No.24 of 2017, pending in the court of the learned Additional Chief Judicial Magistrate-IV, Samastipur.
However, if the petitioners surrender and seek regular bail, the same shall be considered on merit.
