JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 28-09-2015 Heard the Counsel for the petitioner and the Counsel for the Life Insurance Corporation of India (for short "LIC"). Petitioner being the mother of the life insured by the respondent LIC has filed the present application for payment of benefits arising therefrom to her. The wife of the son of the petitioner is also alive and is respondent no. 4. In such circumstances, the petitioner has claimed 50 % of the benefit of the sum assured under the Policy.
In the counter affidavit, respondent LIC has stated that the sum assured and the accidental benefits have been paid equally to the petitioner and the respondent no. 4 way back in the
Patna High Court CWJC No.16532 of 2011 (3) dt.28-09-2015 2/2 year 2012. Details of the cheque through which payments were made have also been stated.
The application, in view of the aforesaid, appears to have become infructuous. It is, accordingly dismissed. (Kishore Kumar Mandal, J) Pankaj/- U
