The petitioner apprehends his arrest in a case registered under sections 498(A) of the Indian Penal Code. Prosecution case in short is that the petitioner being the husband of the complainant along with his mother used to torture her for non fulfillment of dowry demand by way of Rs. 50,000/-. When she made complaint to her father-in-law, he also supported the stand of her husband and mother-in-law. The petitioner used to live in Delhi in connection I with his livelihood and lastly the petitioner talked with her mother on mobile set on which she and her father-in-law assaulted and ousted her from their house after retaining her belonging and stated that the petitioner has performed second marriage with another girl in Delhi.

It has been submitted on behalf of the petitioner that in

Patna High Court Cr.Misc. No.28684 of 2014 (7) dt.14-07-2015 2/2 the mediation centre the parties could not settle the issue. It is further submitted that petitioner is ready to deposit Rs. 2000/- per months in the court below which shall be released in favour of the complainant. On behalf of the State it is submitted that the petitioner is named in the first information report.

Considering the aforesaid facts and circumstances, it is directed that petitioner shall deposit Rs. 2000/- per months in the court below which shall be released in favour of the complainant thereafter the above named petitioner in the vent of arrest or surrender before the court below within a period of four weeks from the date of receipt /production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of S.D.J.M, Saran at Chapra in Complaint Case No. 82 of 2013, subject to the conditions as laid down under section 438(2) Cr.P.C.
