Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code.

The accusation is kidnapping the minor daughter of the informant. The victim in her 164 Cr.P.C statement got her age recorded as 14 years and the learned Court below also assessed as such, where the victim has stated that she was being kidnapped by this petitioner and ravished her and thereafter she was being brought near her house and pushed in a ditch.

Considering the 164 Cr.P.C statement of the victim, let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a

Patna High Court Cr.Misc. No.39315 of 2015 (2) dt.05-10-2015 2/2 period of six weeks in connection with Forbesganj P.S. Case No. 263 of 2015, pending in the Court of learned Chief Judicial Magistrate, Araria.

With the observations above, the application stands disposed off.
