The petitioner seeks regular bail in connection with Agam Kuan P.S. Case No. 796 of 2018 registered for the offence punishable under Section 379 of the Indian Penal Code. The allegation is regarding the accused persons having tried to commit theft in the house of the informant but on alarm being raised, the said accused persons were caught from the spot.

The learned counsel for the petitioner submits that no recovery has been made from the possession of the petitioners so as to implicate him in the alleged crime. It is submitted that the petitioner is languishing in custody since 10.10.2018.

No.79463 of 2018(2) dt.22-01-2019 2/2 Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City in connection with Agam Kuan P.S. Case No. 796 of 2018.
