The petitioner apprehends his arrest in Jamo Bazar P.S. case No. 168 of 2018 registered under Section 272, 273, 308 of the IPC and u/s 30 of Bihar Prohibition & Excise Act. The informant, a police official, alleged that Ramdeo Bharti and Ramesh Bharti, the petitioner, both sons of Parshuram Bharti, were running a poultry firm and in the garb of running such firm they were dealing in illicit liquor. On such, a raid was conducted and nine bottles, each containing 750 ml, Imperial Blue and 19 bottles of Officer Choice, each containing, 375 ml, Indian made foreign liquor were recovered. The learned counsel for the petitioner submits that recovery was made from a brinjal field situated near the poultry

Taking into consideration the aforesaid fact and nature of allegation made against the petitioner and the fact that recovery was made from a brinjal field and not from the poultry firm of the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act Siwan, in connection with Jamo Bazar P.S. case No. 168 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
