The petitioners have renewed their prayer for bail which was earlier rejected.

Learned counsel for the petitioners submits that the trial is going on since a long time, the petitioners may be extended the privilege of bail.

A report was called for about the stage of trial from the Court of Fast Track Court I, Khagaria. It appears from the report that up till now only three witnesses including the informant have been examined. Save and except the Investigating Officer and Medical Officer, the evidence has been

Patna High Court CR. MISC. No.916 of 2019(3) dt.27-02-2019 2/2 concluded and summons have been issued to the Investigating Officer and Medical Officer and the next date for evidence is fixed for 11.02.2019.

Considering the facts aforesaid and stage of trial, I am not inclined to enlarge the petitioners on bail. Accordingly, the same is rejected.

The trial court is directed to hold the trial on day-today basis and conclude the same within a period of two months i.e., positively by 30.04.2019.
