The petitioners apprehend their arrest in Bahera P.S. Case No. 566/2015, registered for the offences punishable under Section 341, 342, 323, 324, 407, 504, 506 and 34 of the Indian Penal Code.

The informant named five persons including petitioner no. 1 Md. Guddu @ Gulab, petitioner no. 2 Md. Danish and petitioner no. 3 Md. Shahid and alleged that they all intercepted and began to abuse her, when the informant protested, on the order of Md. Daud Md. Parvez assaulted the informant with Dabiya on her head.

It is submitted that petitioners are not alleged to have

Patna High Court Cr.Misc. No.29411 of 2016 (3) dt.21-09-2016 2/2 assaulted the informant Noorjahan. Petitioners are alleged to have assaulted mother Mobina Khatoon and Bua Asma Khatoon of the informant, but Mobina Khatoon and Asma Khatoon got simple injuries swelling and pain. There is a counter version bearing no. Bahera P.S. Case No. 568/2015.

Considering the facts aforesaid and the fact that there is case and counter case and the injuries found on the person of Asma Khatoon and Mobina Khatoon are simple in nature, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Benipur, Darbhanga in connection with Bahera P.S. Case No. 566/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
