The petitioner seeks pre-arrest bail in connection with Desari P. S. Case No. 247 of 2015 registered under Sections 406, 409 and 420 of the Indian Penal Code.

It is contended that the amount alleged to have been misappropriated by the petitioner is Rs.1200/- only. The informant has made allegation in the FIR without any evidence against the petitioner. Subsequently, when he came to realize the real facts, he filed a petition for grant of permission to compound the offence. Learned counsel for the State has opposed the application of the petitioner filed under Section 438 of the Code of

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in Desari P. S. Case No. 247 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
