JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 This application, for grant of anticipatory bail, arises out of Nath Nagar P.S. Case No. 560 of 2017, disclosing offences under Sections 457 and 380 of the Indian Penal Code. Allegation against the petitioner is of committing theft in the house of the informant.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is neighbour of the informant and further there is delay in lodging of the F.I.R and nothing has been recovered from the possession of the petitioner.

Having heard both sides, in view of the above facts, this application is disposed of with direction to the petitioner to

Patna High Court Cr.Misc. No.1450 of 2019(2) dt.22-01-2019 2/2 surrender before the court below within a period of six weeks and pray for regular bail and if any such application is filed, the court below will decide the same on the merit of the case, without being prejudiced by the order of this Court.
