In this case, the petitioners are seeking anticipatory bail in connection with Chhatauni P. S. Case No. 116 o 2017, registered for the offences punishable under Sections 420, 406, 504 and 34 of the Indian Penal Code and Section 138 of N. I. Act. Learned counsels for the petitioners submits that the cheque, which is subject matter of criminal case, has not been issued by the petitioners. The alleged cheque has been issued by the son of the petitioners, namely, Bhaskar Jaiswal to the informant.

Looking to the entire facts and circumstances of the case, let the petitioners above-named be released on anticipatory

No.983 of 2019(2) dt.15-01-2019 2/2 bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Chhatauni P.S. Case No. 116 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
