The petitioner seeks bail in a case registered under Section 302/34 of the Indian Penal Code.

The prosecution case in brief is that in course of going to Govindpur Musahri by a motorcycle, the informant's son was assaulted brutally by the accused persons, as a result of which, he sustained serious injuries and was found lying on the road. In the proceeding to PMCH for treatment, he succumbed to the injuries.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 22-10-2018.

Patna High Court CR. MISC. No.22270 of 2019(6) dt.16-08-2019 2/2 Charge sheet has already been submitted. General and omnibus allegation has been made against the petitioner. No specific allegation of assault has been made against the petitioner. There is no disclosure about the weapon, used by the accused persons in the occurrence.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.J. XV, Patna in connection with Phulwarisharif P.S. Case No. 669 of 2018.
