ANJANA MISHRA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as learned counsel appearing on behalf of the informant. The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the allegations are under Section 304(B), the petitioner is not a family member and is just a villager.

Learned counsel appearing on behalf of the informant submits that the petitioner is one of the agnates. However, taking into consideration, the allegations made in the First Information Report and that there is no clear-cut indication that the petitioner was having knowledge about the

No.27591 of 2016 (2) dt.20-08-2016 P2/2 commission of the offence under Section 304(B), let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, VIth, Gaya, in connection with Main P.S. Case No. 13/16, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
