====================================================== CORAM: HONOURABLE MR. JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 12-04-2019 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Darauli P.S. Case No. 256 of 2018 registered under Section 395 of the Indian Penal Code. 8-10 unknown miscreants intruding into the house of the informant committed dacoity and looted cash and jewelery by tiding the informant and his family members with rope. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. The petitioner has committed no offence and has no concern with the aforesaid occurrence. He has been falsely implicated in this case. The petitioner is neither named in the F.I.R. nor any incriminating article has been recovered from his conscious physical possession. Barring the confessional statement of the co-accused Dheeraj Sharma, there is no material indicating the complicity

Patna High Court CR. MISC. No.22839 of 2019(2) dt.12-04-2019 2/2 of the petitioner in the occurrence. No T.I.P. has been conducted. Though one criminal case is pending against the petitioner but he is on bail in the said case. The petitioner has been languishing in custody since 07.01.2019.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Darauli P.S. Case No.256 of 2018.
