JUSTICE SANJAY PRIYA ORAL ORDER 29-01-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Nautan P.S. Case No. 84 of 2009 instituted for the offence under Sections-366(A), 384, 307, 376 of the Indian Penal Code and 27 of the Arms Act. It is alleged in the complaint that while daughter of the informant was going for tuition, this petitioner kidnapped and kept her in the house of his relatives after changing the places. The complainant also received call on his mobile number giving threat to kill his daughter, if, case is lodged in the police station. The complainant on the basis of mobile number, reached at the house of one Laxman Sah and saw his minor daughter there, who told that all these accused persons after kidnapping have committed illegal act with her and want to forcibly marry her. The accused persons forcibly took the daughter of the informant inside the house.

The learned APP after going through the case diary submitted that from case diary, it appears that the girl has not been recovered till date.
Therefore, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected.
