1. Heard learned counsel for the petitioner and learned AC to SC-23 for the State.

2. The learned counsel for the petitioner submits that the land in dispute in the instant writ application pertains to C.S. Khata No.464, C.S. Plot No.1001, R.S. Khata No.942, R.S. Plot No.1662, total area 72 decimals at village- Kena, District- Nawada.

3. The learned counsel appearing on behalf of the petitioner submits that the land in dispute in the instant writ application is raiyati land of the petitioner. It is next

2/4 submitted that out of 72 decimals of raiyati land of the petitioner, the authorities have earmarked 63 decimals of land for constructing a Panchayat Sarkar Bhawan. It is further submitted that the authorities without acquiring the land in dispute are proceeding with the construction of the Panchayat Sarkar Bhawan. It is also submitted that petitioner has filed a representation dated 21.03.2025 before the Collector, Nawada bringing to his notice the dispute for which the instant writ application has been filed. It is submitted that the representation of the petitioner dated 21.03.2025 was received in the office of the Collector on 21.03.2025 itself, but then, the representation has been kept pending till date.

The learned counsel for the State submits that the writ application can be disposed of with a direction to the Collector, Nawada to dispose of the representation of the petitioner dated 21.03.2025, but then, submits that from perusal of the representation of the petitioner dated 21.03.20025, it appears that there is no signature on the same of any officer/employee of the Collectorate showing receiving, hence it is submitted that petitioner be given

3/4 liberty to file a fresh representation before the Collector, Nawada raising his grievance as raised in the instant writ application.

5. The learned counsel appearing on behalf of the petitioner submits that the petitioner will file a fresh representation on or before 10.07.2025.

6. After hearing the learned counsel for the parties, the writ application is disposed of with liberty to the petitioner to file a fresh representation before the Collector, Nawada raising his grievance as raised in the instant writ application on or before 10.07.2025.

7. In the event, if any representation is filed by the petitioner on or before 10.07.2025, in that event, the Collector, Nawada shall dispose of the same in accordance after giving proper opportunity of hearing to the petitioner within a period of two months thereafter.

8. It is made clear that if no representation is filed by the petitioner on or before 10.07.2025, in that event, the Collector, Nawada shall not be obliged to consider the representation of the petitioner.

9. It is further made clear that if any representation

4/4 is filed on or before 10.07.2025, in that event, till the representation is not decided by the Collector, the construction of Panchayat Sarkar Bhawan on the land in dispute shall remain in abeyance.
