The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 504, 506, 332, 333, 353, 186, 187, 188, 189, 325, 307, 337, 427, 342 of the Indian Penal Code. Allegation is that the accused persons including the petitioner armed with lathi, danda came and obstructed government work and also thrown bricks upon the administration.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.01.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the

Patna High Court CR. MISC. No.21238 of 2019(2) dt.11-04-2019 2/2 present case. In respect of murder of cousin brother of the petitioner, there was a protest being made against the police. For the same, F.I.R. was instituted vide Annexure 2 to the present application. The informant claims to have identified the petitioner among crowd of 500 persons. The identification itself appears to be doubtful.

On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. X, Bhojpur at Ara in connection with Sahar P.S. case No.197 of 2018.
