Mr.Sri Surendra Prasad Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is in custody in connection with Muffasil Lakhaura P.S. Case No. 511 of 2017 for the offence under sections 420, 379, 342, 307 and 120(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

In the instant case, petitioner and others have been made accused for attempt to murder by pressing neck of the informant.

Learned counsel for the petitioner would submit that in the instant case Md. Naushad Alam against whom there is

Patna High Court Cr.Misc. No.80459 of 2018(2) dt.15-01-2019 2/2 specific allegation in the FIR, has been granted anticipatory bail by a coordinate bench of this court.

Learned counsel further submitted that other coaccused namely, Guddu Singh has been granted regular bail by a coordinate bench of this court in Cr. Misc. No. 72621 of 2018 vide order dated 14.12.2018.

Considering the fact that petitioner has no criminal antecedent and he is in custody since 28.8.2018 and also the fact that similarly circumstanced other co-accused have been granted anticipatory bail as well as regular bail as indicated hereinabove, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Muffasil Lakhaura P.S.
