The petitioner seeks regular bail in connection with Agamkuan P.S. Case No. 496 of 2018, registered for the offence punishable under Sections 392 of the Indian Penal Code.
The allegation is regarding unknown miscreants having snatched chain from the neck of the informant. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case inasmuch as neither any recovery has been made from the petitioner nor any Test Identification Parade has been held so as to implicate the petitioner with the alleged crime. Patna High Court Cr.Misc. No.79582 of 2018(2) dt.24-01-2019 2/2 submitted that only because the petitioner is accused in three other cases, he has been implicated falsely in the present case. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 08.08.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Patna City in connection with Agamkuan P.S. Case No. 496 of 2018.
