The petitioner apprehends his arrest in Nautan (Jagdishpur) P.S. case No. 397 of 2017 registered under Section 363, 366A, 324, 308, 506,34 of the IPC.
The informant alleged that petitioner with the help of his parents kidnapped her minor daughter.
The learned counsel for the petitioner submits that victim made her statement u/s 164 of the Cr. P. C. She disclosed that her father chided her and she left her house and went to the house of her maternal uncle and from where she fled away and came to her house. Nobody kidnapped her.
Taking into consideration the facts aforesaid and the fact that victim herself denied the factum of her kidnapping, the petitioner, above named, in the event of his arrest/ surrender
Patna High Court CR. MISC. No.23584 of 2019(2) dt.11-04-2019 2/2 before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Nautan (Jagdishpur) P.S. case No. 397 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
