The petitioner is in custody in connection with Paharpur P.S. Case No. 247 of 2018 for the offence under Sections 413 and 414 of the Indian Penal Code. Allegation against the petitioner is that he was sitting on the stolen motorcycle when he was apprehended by the police.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 09.09.2018. He further submits that when the petitioner was crossing the road, the police apprehended him.
