JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-01-2019 This is an application for grant of anticipatory bail in connection with Motihari Mufassil P.S. Case No. 535 of 2018, disclosing offences under Sections 341, 342, 323, 353, 307, 427, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioners is of abusing the informant, who is Rural Rehabilitation Assistant in Kataha Gram Panchayat, and also allegation of assault and threatening him.

Submission of learned counsel for the petitioners is that there is no injury on the person of the informant and they have falsely been implicated in this case. Further submission is that petitioner no.1 is the son of Mukhiya. Petitioners have no

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, District East Champaran, in connection with Motihari Mufassil P.S. Case No. 535 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
