Petitioner is apprehending arrest in connection with Rivilganj P.S. Case No. 62 of 2020 for the offence under section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

In the instant case total 15 liters of country made wine from the bamboo clump.

Considering the fact that the liquor was seized from the bamboo orchard and the petitioner has no criminal antecedent, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest

Patna High Court CR. MISC. No.21465 of 2020(2) dt.23-07-2020 2/2 or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 2nd cum Special Judge, Excise, Saran at Chapra, in connection with Rivilganj P.S. Case No. 62 of 2020 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that on release the petitioner shall render his service as volunteer in dedicated Covid-19 hospital for a period of one month. He is required to report to the district Nodal Officer who shall utilize the service of the petitioner appropriately.
