Learned counsel for the petitioner is directed to remove the defects, as pointed out by the Office, within a period of eight weeks.

The petitioner is apprehending his arrest in a case registered under Sections 341, 323, ,307, 379, 504, 34 of the Indian Penal Code and 37(b)(c) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case, in short, is that the accused persons in drunken state came to the room of the informant and started abusing him and also assaulted him due to which he received injury.

It has been submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.35302 of 2021(2) dt.29-09-2021 2/2 there is no allegation of tampering of witnesses alleged against the petitioner. Specific allegation of assault is alleged against the co-accused namely Golu Kumar Yadav. The petitioner is alleged to have snatched Rs. 5500/- from the informant. The said allegation has been made for oblique reasons. There is no recovery of liquor from the possession of the petitioner. It is alleged that the accuseds were in drunken state. The allegation as made is dened by the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-cumSpecial Judge, Excise, Patna in connection with Shastri Nagar P.S. Case No. 18 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) Pankaj/- U T
