ANJANA MISHRA ORAL ORDER 09-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case as the vehicles which were parked in front of the house of the petitioner and were recovered by the police, have no concern with the present petitioner. The petitioner's name has been brought stating that he was negotiating in the sale of such a vehicle. No recovery has been made from his conscious possession so as to implicate him in connection with the theft of vehicle.

Patna High Court Cr.Misc. No.32583 of 2016 (2) dt.09-01-2017 P2/2 In view of the fact that the petitioner has no criminal antecedent and there is no recovery from his conscious possession, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Mahammadpur P.S. Case No. 66/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
