JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-11-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Complaint Case No. 1291 of 2013 registered for the offence punishable under sections 406, 323, 504 of the Indian Penal Code and section 138 of the Negotiable Instruments Act. Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case only with a view to harass and humiliate the petitioner. As a matter of fact, nothing is due against this petitioner. Moreover, the matter has been compromised between the parties and a petition to that effect has been filed before the Court below. Learned counsel has produced the certified copy of the aforesaid petition,
Patna High Court Cr.Misc. No.25286 of 2017(4) dt.10-11-2017 2/2 which is kept on record. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Madhepura in connection with Complaint Case No. 1291 of 2013 subject to the conditions laid down under section 438(2) Cr.P.C.
