JUSTICE BIRENDRA KUMAR ORAL ORDER 22-01-2019 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 354, 307, 379, 504 and 506 of the Indian Penal Code.

Allegation against the petitioners is of commission of assault with iron rod and spear to the informant. However, the doctor has found simple injury caused by hard and blunt substance on non-vital part of the body.

Patna High Court Cr.Misc. No.79348 of 2018(2) dt.22-01-2019 2/2 Submission is that the allegation of commission of molestation and theft etc. are ornamental one. Petitioners have got no criminal antecedents.

Learned counsel for the informant opposed the prayer for anticipatory bail.

Considering the facts aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Kudhani Police Station Case No.381 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
