The petitioner seeks pre-arrest bail in connection with Anti P.S. Case No. 45 of 2015 registered under Sections 147, 148, 149, 323, 341, 448, 427, 307, 379, 337 and 504 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that four other co-accused, namely, Md. Tauquir, Md. Mustakim, Md. Aftab, Md. Gulam Quadir having more or less identical allegation to that of the petitioner have already been granted pre-arrest bail vide order dated 02.05.2016 passed in Cr.
Patna High Court Cr.Misc. No.28908 of 2016 (2) dt.25-07-2016 2 / 2 Misc. No. 16135 of 2016. A web copy of the aforesaid order has been produced by the learned counsel for the petitioner in course of argument. Let the same be kept on record.
Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate2nd, Gaya in connection with Anti P.S. Case No. 45 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
