Petitioner seeks bail in a case registered for the offences punishable under Sections 20 and 22 of the N.D.P.S. Act.
Call for an explanation from the Superintendent of Police, Jamui as to why no prosecution witness has been examined in connection with Chandramandi P.S. Case No. 70 of 2017 in spite of framing of charges on 01.12.2017 and issuance of summons to the prosecution witnesses through the Superintendent of Police, Jamui.
The allegation relates to recovery of 10 Kg. of Ganja. If the Superintendent of Police, Jamui would not ensure examination of the prosecution witnesses within a period
Patna High Court CR. MISC. No.1415 of 2019(3) dt.13-03-2019 2/2 of four weeks, the failure of prosecution case may affect the credibility of the stake holders.
With the aforesaid observation, I am not inclined to review earlier order of rejection of bail dated 11.01.2018 passed in Cr. Misc. No. 61072 of 2017.
Hence, prayer for bail is again refused in connection with NDPS Case No. 07 of 2017 arising out of Chandramandi P.S. Case No. 70 of 2017 pending in the court of learned 1st Additional Sessions Judge, Jamui.
