Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Risiup/Risiyap P.S. Case No. 10 of 2023 registered for the offence under Sections 341/323/307/504/506/34 of the Indian Penal Code.

As per the prosecution case, the informant states that while the informant had gone Pichuya Tal Badhar situated in the west side of the village for taking grass for animals, at about 4PM, the informant's co-villager Ramesh Paswan, Surendra Paswan, Ramashish Paswan, Brajesh Paswan and Suva Paswan all armed with lathi and danda came there and started abusing

Patna High Court CR. MISC. No.23989 of 2023(2) dt.18-05-2023 2/2 the informant. Ramesh Paswan with an intention to kill assaulted the informant, with lathi on his head causing injury on his head. On receiving injury the informant fell down after which all the accused persons assaulted the informant with fist and slap.

Learned counsel for the petitioner submits that the petitioner is in custody since 16.01.2023 and the petitioner is innocent and has committed no offence.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Risiup/Risiyap P.S. Case No. 10 of 2023.
