Learned counsel for the petitioners is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.

The petitioners are apprehending their arrest in Jankinagar P.S. Case No. 87 of 2020 registered for the offence under Sections 143, 341, 324, 307, 354, 379, 427, 504 and 506 of the Indian Penal Code.

No.36002 of 2021(2) dt.06-04-2022 2/3 Allegation against the accused persons including the petitioners is that they surrounded the house of informant and started assaulting his Bhabhi, Sahina Khatoon and also torn her cloths. Co-accused Md. Dilsad is said to have given sword blow on the head of husband of Shabina Khatoon, due to which, he sustained injury. The other family members of the informant were also assaulted and they sustained injuries. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been falsely implicated in the present case. So far petitioners are concerned, general and omnibus allegation has been made against them. No specific overt act is alleged against the petitioners. The specific allegation is against the co-accused Md. Dilsad, Md. Kamal, Md. Salauddin and Md. Jiyabun.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on

Case No. 87 of 2020 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
