The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Chapra Muffasil P.S. Case no. 253 of 2021 instituted for the offence under Sections 147, 149, 341, 323, 332, 353, 224, 225 and 504 of the Indian Penal Code.

As per allegation in the FIR, petitioner along with other co-accused persons have created hindrance by lathi, danda and pelting stones to the police party in discharging the official duty when the police officials have visited to village Tenua to apprehend the petitioner and other accused persons, who were accused in a rape case, but they managed to escape. Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.24220 of 2022(2) dt.10-10-2022 2/2 has submitted that petitioner is innocent and has committed no offence. General and omnibus allegations have been levelled against him. Neither the petitioner was arrested on spot nor any incriminating article has been recovered from his possession. Learned APP appearing for the State has opposed the prayer of Bail and submitted that petitioner's involvement in the alleged crime cannot be ruled out.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is not inclined to grant privilege of anticipatory bail to the petitioner. His application for bail stands rejected. (Sunil Kumar Panwar, J) sushma/- U
