Petitioners are apprehending their arrest in Laxmipur (Gidhour) P.S. Case No. 186 of 2016 registered under Sections 323, 341, 379, 504 and 354/34 of the Indian Penal Code. It is alleged that the petitioners along with other accused simply entered into the house of the informant and started assaulting inmates. They were also confined in the room and some articles were stolen. The reason assigned in the F.I.R. that the petitioners used to tease her daughter-in-law every now and then which was protested by the informant and his son. Counsel for the petitioners submits that on the same day, F.I.R. was lodged against the present prosecution party for having

Patna High Court Cr.Misc. No.24898 of 2017 (2) dt.13-07-2017 2/2 committed theft in the house of the petitioners. Mr. Dayal appearing for the State submits that there is specific allegation attributed to the petitioners which found support from the investigation report as noticed by the learned Sessions Judge.

Considering the facts and circumstances of the case, I am not inclined to direct release of the petitioner on anticipatory bail. Prayer is rejected.
