JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2019 Earlier prayer for bail of the petitioner was dismissed vide order dated 12.10.2018 passed in Cr. Misc. No. 51683 of 2018 and allegation against the petitioner is that on hearing the sound of hue and cry of his brother Mantosh Kumar, Raushan Kumar, younger brother of Mantosh Kumar and nephew of informant came out and saw the petitioner and other accused persons stabbing the deceased and further the witnesses have stated that this petitioner and others have caught hold the deceased allowing other accused persons to stab the him. Submission of learned counsel for the petitioner is that he has been in judicial custody for more than fifteen months and uptil now no substantive progress has been made in trial, though case has been committed in the court of Sessions. Heard learned A.P.P. also.

No.22591 of 2019(2) dt.11-04-2019 2/2 Having heard both sides, considering the facts and circumstances of the case, at this stage, I am not inclined to enlarge the petitioner on bail, however, the trial court is directed to expedite the trial and if substantive progress made in the trial, petitioner will be at liberty to renew his prayer for bail. This application is accordingly dismissed.
