The petitioner seeks bail in connection with Janta Bazar P.S. Case No. 154 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act-2016. 1035 lts. of foreign liquor is said to have been recovered from the room of Government Sanskrit School, Dayalpur kept by the petitioner and three other accused persons, who managed to escape on raid seeing the police party. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has no concern either with the seized liquor or with any trade of liquor. He was not apprehended on the spot. There

Patna High Court Cr.Misc. No.79282 of 2018(2) dt.18-01-2019 2/2 is no compliance of Section 100 Cr.P.C. He has been falsely implicated in this case at the instance of local Chowkidar due to animosity. Barring the aforesaid disclosure of the Chowkidar, there is nothing in the record indicating the complicity of the petitioner in the occurrence. Though, one more case under Excise Act has been lodged against the petitioner, but he is on bail in the said case. He has been languishing in custody since 18.11.2018.

Learned APP opposed the bail prayer of the petitioner.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional Sessions Judge, Saran at Chapra in connection with Janta Bazar P.S. Case No. 154 of 2018.
