Learned senior counsel for the petitioners, at the outset, submits that petitioner no.4 has been arrested during the pendency of the present anticipatory bail application as such seeks permission to withdraw the anticipatory bail in respect of petitioner no. 4.
Permission is accorded.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 302, 354,
Patna High Court CR. MISC. No.35083 of 2021(2) dt.13-06-2022 2/2 341, 323 and 34 of the Indian Penal Code.
Learned senior counsel for the petitioners submits that the petitioners are persons with clean antecedent and from perusal of the F.I.R. it would manifest that the date of occurrence is 11.04.2020 and the F.I.R. was instituted on 21.05.2020.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the period of delay in instituting the F.I.R., the petitioner nos. 1, 2 and 3, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Daudnagar P.S. Case No. 136 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
