The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 343, 323, 504, 506, 379/34 of the Indian Penal Code and Section 47 of the Bihar Excise Amendment Act, 2016.

It appears that present petitioner has lodged a case against Arjun Rai, Pankaj Kumar and others making an allegation that they have caused injury on his head by sword. Learned counsel for the petitioner submits that petitioner was under treatment in the hospital. Arjun Rai lodged a case against the petitioner while he was under treatment. Indrajeet Kumar came to the hospital on a motor cycle and took out

Patna High Court Cr.Misc. No.24802 of 2017 (2) dt.11-07-2017 Rs.40,000/- from the pocket of the uncle of the informant. At the same time petitioner forcibly inserted and kept 2-2 bottles of liquor each in the pocket. He further submits that again in retaliation Arjun Rai filed another case in which allegation of assault has been made.

It appears that story of putting liquor in the pocket of the petitioner is false.

Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioner, namely, Indrajeet Kumar alias Indrajeet Rai, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-V, Vaishali at Hajipur in connection with Hajipur (Town) P.S. Case No.640 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) Vinay/- U T
