====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 22-07-2015 Heard learned counsel for the petitioner and learned AC to AAG-15 for the State.

A counter affidavit in terms of the order of the Court dated 30.06.2015 has been filed by the Senior Superintendent of Police, Patna. From the averments made in the counter affidavit it transpires that the case has been found true under Sections 306/201/34 of the Indian Penal Code and 3(2)(v) of The Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. It has further been stated that the Senior Superintendent of Police, Patna has reviewed the entire matter and issued Report-3 on 20.07.2015 with a direction to the Investigating Officer to conduct the

Patna High Court Cr. WJC No.769 of 2014 (10) dt.22-07-2015 2/2 investigation on the points mentioned in the progress Report and complete the investigation immediately. It has further been stated that two accused have been arrested on 21.07.2015. The Senior Superintendent of Police, Patna has also requested for three months time to complete the investigation and file chargesheet against the accused persons and others in connection with the present case. In view of the aforesaid, this Court does not deem it necessary to keep the matter pending. Accordingly, the application stands disposed off with a direction to the Senior Superintendent of Police, Patna to ensure that the investigation is completed and final police report submitted before the Court concerned at the earliest and in any case latest by 31st October, 2015.

Registry shall communicate the order to the Senior Superintendent of Police, Patna through Fax also latest by tomorrow.
