07-10-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in G.R. No. 3161 of 2019, arising out of Kotwali P.S. Case No. 514 of 2019, registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, the allegation against petitioner is that he abused the informant and thereafter, took out a pistol from his waist and shot at informant, but it misfired and no injury was caused to the informant.

It is submitted on behalf of petitioner that present case is counter blast of Kotwali P.S. Case No. 512 of 2019 lodged by the petitioner against informant of this case and only

Patna High Court CR. MISC. No.24576 of 2020(2) dt.07-10-2020 2/2 with a view to save his skin, the informant has filed the present case. In paragraph - 12 of the petition, it is stated that the informant, due to his person grudge, lodged two more cases against petitioner, as stated in paragraph - 3 of the petition, in which, petitioner is already on bail.

Considering the aforesaid facts and circumstances, the bail application of petitioner is allowed. In the event of his arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Nand Kishore Ram, learned Chief Judicial Magistrate-II, Munger/A.C.J.M.-II, Munger/concerned court in connection with G.R. No. 3161 of 2019, arising out of Kotwali P.S. Case No. 514 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
