====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 29-04-2025 Heard Learned Counsel for the petitioner, Learned Counsel for the State and Learned Counsel for the Bihar State Pharmacy Council (BSPC).

Learned Counsel for the petitioner submits that the present writ petition has been filed for directing the respondents to make payment of salary from the month of June, 2017 till today with interest when the petitioner has given his joining on 30.12.2013 the Annexure-P/3 of the petition when he was appointed on the post of clerk by the Registrar, Bihar State

Patna High Court CWJC No.6440 of 2025(2) dt.29-04-2025 2/3 Pharmacy Council vide Letter No.490 of 2013 dated 24.12.2013 the Annexure-P/2 of the petition but the Pharmacy council has withheld the salary of the petitioner stating that the operation of the account of the Bihar State Pharmacy Council Bank was withheld.

3. Counsel for the petitioner submits that payment of the petitioner has been withheld. In this regard, the petitioner has filed his representation before the Registrar, Bihar State Pharmacy Council (respondent No.6), but the same is pending.

4. Counsel for the BSPC submits that initially, council was not functional. The functioning of the council has been started in the recent future. Therefore, the petitioner may be directed to file a fresh representation before the Registrar, Bihar State Pharmacy Council and council may be directed to take appropriate decision.

5. Counsel for the State submits that BSPC has been constituted in the light of Bihar Pharmacy Act.

In the light of the submissions made by the parties, this Court hereby disposed off the present writ petition directing the petitioner to file a fresh representation describing all the factual matrix within 30 days from today, before the Registrar, Bihar State Pharmacy Council and the Registrar shall pass a

Patna High Court CWJC No.6440 of 2025(2) dt.29-04-2025 3/3 reasoned and speaking order within 90 days from the date of receipt of the said representation.
