The petitioner apprehends his arrest in Ekma P.S. Case No. 22/2017, registered for the offences punishable under Sections 307, 325 and other Sections of the Indian Penal Code. The informant alleged that he was pulling cart and when he reached near the house of Shishwak Sah, the hand of the daughter of Shishwak Sah touched by his Thela. Some altercation took place and Panchayati was also held. The petitioner is alleged to have assaulted Nagendra Sah, brother of the informant, with Farsa on his head.
Learned counsel for the petitioner submits that there is a counter version being Ekma P.S. Case No. 31/2017. The petitioner was brutally assaulted by the other side, but it appears
Patna High Court Cr.Misc. No.26337 of 2017 (2) dt.13-07-2017 that there is specific allegation that the petitioner assaulted Nagendra Sah with Farsa on his head and injury was found on the left parietal occipital.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner, above named, on anticipatory bail. Accordingly, the same is rejected.
