The appellant seeks pre-arrest bail in connection with Complaint Case No.C1 410/2010 (Tr. No.1739 of 2017) registered for offences punishable under Sections 341, 323, 406 of the Indian Penal Code and Section 3(i)(x) of SC/ST Act.
Allegation against the appellant is of abusing the informant by taking caste name.
Submission of learned counsel for the petitioner is that in this case, final form has been submitted by the police, but cognizance has been taken.
Learned Special P.P. could not controvert the above submissions of learned counsel for the appellant.
Patna High Court CR. APP (SJ) No.30 of 2019 dt.08-02-2019 2/2 Having heard both sides, considering the facts and circumstances of the case, let the appellant, above named, in the event of his arrest or surrender before the Court below, be released on bail on furnishing bail bonds of Rs.25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-I, Vaishali at Hajipur in connection with Complaint Case No.C1 410/2010 (Tr. No.1739 of 2017), subject to the conditions laid down under Section 438(2) of Cr.P.C.
Accordingly, this appeal is allowed and impugned order is set aside.
