ANJANA MISHRA ORAL ORDER 13-01-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Runnisaidpur P.S. Case No.337 of 2014 for allegedly having committed the offence under Sections 147, 148, 149, 323, 324, 307, 379, 427 and 504 of the Indian Penal Code.
Case diary in the present case was called for, which has since been received.
Learned counsel for the petitioner submits that though there is an allegation that the petitioner assaulted one Jitendra Pathak during the course of altercation, which took place between the two groups of bus owners, the alleged injury
Patna High Court Cr.Misc. No.49589 of 2015 (4) dt.13-01-2016 2/2 on the person of Jitendra Pathak is simple in nature. He further submits that the petitioner is merely an auto driver, who was standing as a bystander and has nothing to do with the occurrence.
Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S. Case No.337 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
